Homeland Security Secretary Chertoff's unprecedented power to waive any law he deems necessary to hasten construction of the U.S.-Mexico border fence might be unconstitutional.
It's amazing how, when common sense, public opinion, the rule of law, property rights, environmental concerns, congressional authority, and judicial review are all thrown out the window, there's still that piece of paper drafted by imperfect old white men two hundred years ago to fall back on.
